These Mendix Exam Terms (the “Exam Terms”) only apply to the participation in the Mendix Certification Exams (“Exam” or “Exams”) once you have entered into a contract with Digital River as our authorized reseller. To that extent, these Exam Terms complement the Digital River’s Terms of Sale that are also presented to you in the checkout process with Digital River.

By checking the box in the checkout process with Digital River, you agree to also be bound by these Exam Terms. If you do not agree to these Exam Terms, you cannot register for the Exams.

1. If you register on behalf of your organization, these Exam Terms will also apply to your organization. In this case, you confirm and warrant that you are authorized to represent your organization.
2. Depending on your knowledge and skill level, you may choose Exams at different levels: the Intermediate Developer, Advanced Developer, and Expert Developer Certification. Additional Exam rules for each level are provided in the corresponding Exam Guides which are included in these Exam Terms. You can access the Exam Guides through the following links:

  Please review the relevant Exam Guide before taking the Exam to understand the specific rules and requirements.

3. In the event of cheating or similar misconduct (such as stealing Exam questions and answers), Mendix has the right to temporarily ban you from taking Exams and revoke any improperly obtained Certification. Additionally, Mendix can also ban your organization if its employees repeatedly cheat or engage in similar misconduct. The ban will remain in effect until Mendix is satisfied that your organization is taking all necessary measures to prevent its employees from engaging in cheating or similar misconduct.
4. Mendix will make reasonable commercial efforts to ensure that the Exam is carried out with reasonable skill and care, following industry-standard practices. Any conditions and warranties that are not explicitly stated in these Exam Terms, whether expressed or implied, including, but not limited to, the fitness for a particular purpose, are excluded to the fullest extent permitted by law.
5. You (and your organization) shall indemnify and hold harmless Digital River and Mendix, its officers, directors, agents, and employees, from and against any claims, actions, demands, losses, costs, expenses (including, but not limited to, legal fees and disbursements), damages, liabilities, and lawsuits arising from any breach of your (or your organization’s) obligations under these Exam Terms.
6. All intellectual property rights in or arising out of or in connection with the Exam, including any associated Exam materials shall be owned by Mendix. The Exam materials may not be reproduced, scanned, or copied (in whole or in part) without the prior written consent of Mendix.
7. Mendix collects and processes your Personal Data for the purpose of managing and registering Exams. For detailed information on how Mendix handles your Personal Data, please refer to the Mendix Privacy Notice, which is available at https://www.mendix.com/privacy-policy.
8. Mendix may change its business and the Mendix sites from time to time. As a result, Mendix may need to make changes to these Exam Terms. For this purpose, Mendix reserves the right to update or modify these Exam Terms at any time without prior notice. Please make sure to review these Exam Terms regularly to ensure that you remain informed of any changes.
9. Dutch law shall govern these Exam Terms.
